Legal, Physical, and Primary....what's the difference?
The first family law order I prepared was like Latin to me (a lot of the law literally is Latin). But 100's of family law orders later I've come to realize that it can actually be broken down very simply. So here goes:
The two main parts of custody to really understand are Legal custody and Physical custody. We'll worry about Primary Custody and how Child Support plays into this a little later.
Legal Custody: Legal custody is easy, it just means who gets to make the important decisions in a child's life--almost always the big three: what school they will go to, what medical treatment they will get, and what religion they will be raised in. Assume it's always joint, or 50-50. The only other alternative is sole, to one parent. You usually can't have a 40-60 split legal custody. Absent some kind of detriment, such as a parent who uses drugs, abuses the children, or perhaps is in prison and not able to assist with legal decisions, legal custody is 50-50. But what if there's a tie vote? Then you either have to deal with it on your own, or drag the other parent into court. For Jon and Kate, legal is 50-50.
Physical Custody: A little harder, but not bad. Who will spend what percentage of time with the children? It can be 50-50, or any other combination. When you have more than 50, you are considered to hold "physical custody" with the other parent having visitation rights. Holding physical custody is by no means an automatic indication the other parent never sees the kid or it's some kind of victory for you. It just means, you happen to have the children the majority of the time. What's more important is how much primary do you have? Do you have 70 to 80 percent? Well, then you might want to brag. Here, Kate has physical custody, because her time with the children is more than 51 percent. We have not been told the exact percentage she holds or the arrangement. For all we know, she could have 51 percent, given we see Jon with the kids all the time. When you have less than 50 percent, then you are referred to as holding "visitation rights." Jon has visitation rights, that's all we've been told. It gets complicated because actually arranging what time who spends with whom can be a nightmare. In general, the more time you spend with the kids, the less child support you pay.

1. Today Kate took Cara to the dentist. No nanny, no bodyguard, just Kate doing what a normal mom does. Kate was also dressed a little more mom-ish. Still hip, but not over the top. Good job!

Paula Deen was reportedly worried her show would be too much attention for Kate
Paula Deen is so cute, worrying about Kate. We are more likely to worry about the kids, as in how much time away from home a talk show in another state starring their mother would require, but hey, someone has to worry about Kate.

Police appear to have ruled Hailey out for the time being
Hailey was questioned by the police Saturday and her mother Sunday. No arrests were made and no charges filed. The police don't seem to be centering their suspicions on her.

Bodyguard Steve spends another holiday with Kate
Update: Hailey gets lawyer, intends to cooperate with police
Coincidence or not, Jon's ex-girlfriend Hailey just last Friday was reportedly furious when Jon allegedly pocketed her half of the rent money instead of paying rent. Hailey has retained New York attorney Stephanie Ovadia (pictured at right) to help her through this mess. Reportedly, she intends to speak with police and cooperate.
Meanwhile, forensic experts are analyzing the note left behind signed with her name.

Radaronline slams Jon's sledding time with his kids

Just so Radaronline knows, both Jon and Kate have admitted several times that Jon is a very hands on parent. Jon got the kids up and ready for school while Kate slept. Jon served Kate coffee made to order in bed. Jon worked a full time job, then came home and looked after the children some more. Jon did baths. Jon did tucking in. Jon did the driving, the gas. Jon spent almost every weekend working on a project to help the family, such as giving the twins bigger bedrooms. He rarely if ever went out with friends. He was incredibly involved in his eight children's lives and he was one of the most hands-on fathers we've ever seen. Up until recently, he was the kind of father most men can only hope to be.
This is not unusual to see Jon spending time with the kids. What's unusual is that the media is actually reporting that he is spending quality time with them.
Radaronline can stop spinning this story every which way they can in Kate's favor and report the facts. Fact: Jon spent quality time with the kids yesterday. Fact: Jon has spent quality time with the kids over and over and over, many, many times in the past.
We have said ad nauseam, Jon and Kate have both made mistakes. They have both screwed up. But they also have both made good choices. But for some reason, Jon's good choices are rarely reported. Or when they are, they are spun in this shameful manner. We will report it here. Fathers are often treated differently in a divorce, and clearly in this case, Kate successfully got most of the media on her side and against the father. But we will report what is going on with this family as fairly as possible, always.

We have a sneaking suspicion she also couldn't get along with fellow divas like Paula Dean. It's a small world in diva land.
Kate's show with TLC is still in the work, recently filming a test shoot in North Carolina. Sequels often flop; will Kate be able to make her show work? If it even gets the green light. TLC has to make money--clearly that's all they care about. And if the test numbers are poor, they will drop Kate faster than a rock.

Jon was at the family home yesterday enjoying visitation. He spent the afternoon pulling the kids around on sleds. Looks like everyone was having a ball.
Kids don't need fancy vacations, clothes, toys, schools, or mansions. They need a sled ($10 at Target), snow (free), and Daddy (available on visitation days).

Jon tries to trade in his BMW and downsize
Perhaps finally realizing how much his lifestyle exceeds his income (we've been saying this for years), and with a huge monthly child support order to pay now, Jon was spotted Friday at a used car lot .... trying to trade in his BMW for a more economical car, a Subaru, plus some cash. But apparently not able to come to a deal he was happy with, Jon drove off with the same BMW.

Kate out shopping Sunday

Jon ordered to remove firearms from property
After photos surfaced of Jon practicing shooting a pistol on the property yesterday, the court ordered today Jon is not to have any firearms on the property.

Divorce won't be final until the new year
Despite reports an arbitrator had reached a decision, Jon's lawyer says the divorce probably won't be finalized until 2010.
Interestingly enough, he also denies Jon is hurting for cash.

Arbitration decision is in on divorce
TMZ is reporting that the Arbitrator has reached a decision on division of assets and other issues in the Jon and Kate divorce and submitted it to the Court. The decision remains confidential. If true, the judge need only sign off for the divorce to be finalized.

Jon is broke
It's obvious Jon is broke, but a source has confirmed it today. The source says Jon was counting on media appearance, but now that there is an injunction, he has no income. They say he is making no effort to try to get a job outside the entertainment industry.
A big mortgage, expensive house to maintain, 8 kids to provide for, 8 private school tuitions, expensive cars....it's probably time to downsize.
And again, shame on TLC for taking money from the children. This is their provider, a fact they overlook.

Tiger Woods smashes Jon and Kate into the nearest sandpit
Tiger Woods' recent drama is so much more salacious and interesting than Jon and Kate can ever hope to be. Jon and Kate's shenanigans are only for beginners. Their 15 Minutes are coming to an end, and Tiger Woods may have just pushed that minutes' hand to number 16. That is certainly not whom anyone expected would do it, but we are grateful just the same.
Here are some tips for Jon and Kate to keep their story going.
1. Don't act like a douche. Then people just expect bad behavior, which is boring. Always behave completely uprighteous and morally correct, only leaking a few beautiful family photos to the press featuring your kids and dogs. That way when you screw up it's all the more shocking.
2. Always say no comment. Always. Never talk to the press and always remain secluded. It is much more interesting for the public to speculate what you might say or do, than to release some stupid carefully crafted press release that is gone and forgotten within 24 hours.
3. Do something completely shocking, like crashing your car at 2 am outside your own home, then be incredibly vague about how it happened and don't explain things that don't add up, like why the back window was broken to get you out when you were sitting in the driver's seat.
4. A little domestic violence in your morally upstanding relationship, or rather just a few clues their might be domestic violence, is incredibly interesting.
5. Lots of women creates more tabloid covers and more opportunities for stories, rather than just one or two.
6. Children's services should be investigating your family. You don't want to actually get your kids taken away, but just the suggestion that you might keeps people glued.
7. Release a few clues every few days, but nothing to actually explain the whole thing. A few voice mails, text messages, police reports, and medical records, slowly made public over several weeks, keeps the story going forever.
8. Be happy when you are a parody on Saturday Night Live. Congrats, you've made it.
But seriously, we hope Jon and Kate's ridiculous story has come to an end and that they will quickly fade into obscurity. And we wish Tiger Woods and his family all the best in working through their many problems.

Why was TLC required to post bond? Because they might lose.
Some questions have come up in comments about the $50,000 bond TLC was required to post.
Contrary to many Internet reports, TLC has not "won" their lawsuit, had their contract declared valid, received damages from Jon, or anything of the like. They have simply had a preliminary injunction granted to stop Jon from unauthorized appearances pending the result of the lawsuit.
When you hear bond, most people think jail. But this is not a criminal case, so this is not the same as getting out of jail. It's a "civil bond" or a "surety bond."
Surety bonds can be used for a wide variety of purposes, but in this case it may be required to ensure TLC will be cooperative in the lawsuit, attending all court dates, come prepared, etc. If they don't, the judge can easily pull money from their bond. Thus, a strong incentive to be on their toes. It also assumes that most lawsuits are a drain on a court's resources and time, and thus a drain on the taxpayer. So if TLC loses, they may be required to compensate taxpayers for waste of time, and money can be taken from the bond they've posted. If they win, they get the bond back. One of the main purposes is to protect taxpayers and discourage unnecessary lawsuits. It is also an incentive to settle the case in Mediation, or risk losing the bond if they gamble on a trial and lose.

Jon's lawyers could have requested TLC post bond, or the judge could have just ordered it on his own motion.
Either way, we think it is a strong message from the judge that TLC better be serious about coming to an agreement with Job, or risk losing a lot of money.

Jon missed court to stay with the kids
Jon Gosselin missed his court hearing yesterday (his appearance was not required), and the Kate camp was quick to jump all over him for not showing up.
Jon however, reports a variety of sources today, stayed home with the children. Perhaps Kate was still out making her new show and couldn't watch them?
We're just happy the kids weren't left with the nanny again.

Jon and TLC headed to Mediation to try to resolve dispute

Before the big trial day of April 19th, Jon and TLC will take a crack at settling the case in Mediation. Mediation usually involves a neutral mediator, not necessarily an attorney but someone experienced in helping resolve disputes. If all the parties agree and the judge approves the settlement, it is just as binding as a resolution a trial would be.
Good luck to the parties. Alternative dispute resolution is almost always less emotionally draining, costly, and lengthy as a big trial.
In the meantime, Circuit Judge Michael Mason has ordered Jon must get written consent before making public statements about the show, TLC or Discovery. He cannot do media "except insofar as such appearances" are unpaid and meet certain other terms, according to the order.

BREAKING NEWS: JUDGE GRANTS PRELIMINARY INJUNCTION

A judge has granted TLC's preliminary injunction and Jon may not make any appearances pending trial. Jon's attorneys argued that Jon's breach did not cause "irreparable harm," a requirement to get an injunction. In fact, they pointed out, TLC's ratings have been through the roof since Jon breached the contract. The judge disagreed. What does this mean for Jon? Well, he is not allowed to make any appearances, or really, do anything, pending the upcoming trial. Jon argued that his media appearances are his livelihood. TLC argued he is an IT tech and hasn't done anything to go out and get a job. The judge says no more media for Jon until the outcome of the trial.
What is a preliminary injunction?
Think of a preliminary injunction like a temporary restraining order. It is typically issued pending a judge's final decision, just as it was here. Because Jon could continue breaching his contract and causing even more harm to TLC between now and the trial date of April 19th, a judge has "restrained" him from doing anything else until he sorts this all out. Jon may still be able to make appearances after his trial, he is only temporary stopped from doing so.
Next court date April 19.

They have now corrected their story to explain, as we did from the beginning, that the Court only granted TLC's injunction and not their whole case yet. TLC sees this as a "validation" of their contract, but it is no such thing. TLC also says they will comply with Jon's request to stop filming the kids: "If the father of the children states an objection of the kids being filmed, we're gonna honor that."

Andrews Ave. house sells

Radaronline is reporting Jon and Kate's Andrew's Ave. house has sold for around $300,000.
The price was just recently dropped from the mid-300's, a number very likely far too high to generate any interest in this market.

Kate says kids are sobbing for the camera crew

Kate will be part of Barbara's Top 10 People of 2009 tonight on ABC, and it's been leaked that she tells Barbara the kids are sobbing because they miss the camera crew.
It's probably true the kids are upset. But what Kate doesn't realize is that it's not that we think she is exaggerating or lying about their emotional state. They probably are upset. The problem is they have had such a dysfunctional childhood in the first place that they are now in a place where they are crying for a bunch of 20-something, pot smoking, scruffy haired young men thrilled to be in show business, even in the middle of PA. That is a problem. The kids need to get normal friends their age, relatives and close friends to become attached to and not crew members, and a routine that doesn't involve a flux of said strangers in and out of their lives. Hopefully that has started and will continue.

Kate starts filming new food show
That didn't take long. Kate was caught at Finch's Restaurant's in North Carolina today, full camera crew with her, filming her cooking at the restaurant. Bodyguard and rumored lover Steve was with her, and told reporters they were filming a "test" for her new show. The kids? With the nanny we assume.
Speculation continues that Kate is beginning some sort of organic food show. TLC has confirmed they intend to begin a new show starring Kate to air this spring.

Even Barbara Walters knows kids deserve privacy
A few days ago, Barbara Walter's 10 most facinating people of 2009 list was leaked, and Kate Gosselin is on the list. Also on the list, however, are Michael Jackson's young children.
The typical format of Wa-wa's top 10 list is a brief interview with each person, usually in their own environment such as at their home. But was Wawa going to interview the Jackson children about everything they've been through this year? Exploitive, much?
Fortunatly, there will be no interview. The segment will feature old footage including old interviews with Michael. The children will be left to their privacy.
Even Barbara knows kids don't need cameras in their faces.

Mady has the happy back in her step
Mady Gosselin is probably one of the most "controversial" of the plus eight. Lots of viewers think she's a stuck up brat, while others feel terribly sorry for her.
The change in Mady since filming stopped has been dramatic, and it's a real relief. Whether you thought her a brat, or just a normal child in a terrible situation, it is so wonderful to see her smiling cheerful face. Up until now, we were hard pressed to find a candid photograph of Mady smiling that is more recent than at least a few years ago. The past few years have really been a drain on her.

Let this be just the beginning of the pep in her step.
Jon's lawyers say TLC prevented him from making Super Bowl commercials
Any man's dream is to be involved in the Super Bowl somehow, if only in a commercial on the big day. Jon's lawyers say he was offered at least two Super Bowl commercials for next year's game. But TLC prevented him from accepting them. His lawyer calls the move "mean-spirited."

Kate can't put her cell phone down either
In yet another case of what's good for the goose must be good for the Gosselin, Kate was caught out with Mady yesterday in Reading .... on her cell phone the whole time.
In the last few episodes of the series, Kate infamously accused Jon of, among other things, being on his cell phone all the time and ignoring the kids. (Parental alienation going on here?) However we were easily able to count up at least six separate incidents in which Kate has been glued to her hot pink iPhone. And as of yesterday, seven. If you're going to bash the children's father, at least make sure you can't be accused of the same thing.
On another note, is was so nice to see how happy and carefree Mady seemed on this outing, happier than she has seemed in a long time. Could it be because this 9-year-old is no longer slave to a grueling production schedule?

Internet buzz claim the move is because TLC is anxious to get Jon. But a few days is not all that significant. It could simply be due to court congestion. And all parties have to agree on the new dates. If Jon's side is not ready, they simply tell the judge they need more time. Certainly when dates are moved UP, all parties must agree (it's a different story when dates are moved back). Kate Gosselin on Barbara's list for most facinating???
Barbara Walters has picked her 10 most facinating people of 2009, and it looks like Kate is on the list. Kate? Seriously, Wawa?
What's facinating is if the Gosselin children are able to muddle through the rest of their childhoods without any significant emotional problems from their parents' divorce played out on everyone's televisions.
Also reportedly on the list: Sarah Palin, of "bring me my retarded baby" fame, Lady Gaga (whata now?) and Adam Lambert. Pleassse.
We have some suggestions for Barbara for the real facinating people out there from 2009. Not ego-maniacs revelling in their 15 Minutes.
1. Police Officer Kim Munley, who opened fire on the Fort Hood gunman and stopped the rampage, saving who knows how many lives.
2. Sully Sullivan, who landed U.S. Airways Flight safely in the Hudson River earlier this year.
3. California firefighters, who this fall fought and saved thousands of homes and lives from some of the biggest forest fires the state has ever seen.
4. Barack Obama, sworn in as the nation's first African-American president in January and awarded the Nobel Peace prize.
5. Michael Oher, the homeless African-American teenager who eventually graduated from high school, college, and started playing football for the Baltimore Ravens this season. His story is told in the newly released film "The Blind Side."
