Jon and TLC headed to Mediation to try to resolve dispute

http://www.washingtonpost.com/wp-dyn/content/article/2009/12/10/AR2009121004178.html

Before the big trial day of April 19th, Jon and TLC will take a crack at settling the case in Mediation. Mediation usually involves a neutral mediator, not necessarily an attorney but someone experienced in helping resolve disputes. If all the parties agree and the judge approves the settlement, it is just as binding as a resolution a trial would be.

Good luck to the parties. Alternative dispute resolution is almost always less emotionally draining, costly, and lengthy as a big trial.

In the meantime, Circuit Judge Michael Mason has ordered Jon must get written consent before making public statements about the show, TLC or Discovery. He cannot do media "except insofar as such appearances" are unpaid and meet certain other terms, according to the order.

I hope this doesn't work out. If it does, those kids will be working to keep Mommy and Daddy in the lifestyle they have become accustomed to.

What is there to mediate? I hope it is not an opportunity for TLC to promise to back off on Jon if he allows filming of the kids.

The entire case can be mediated, all of the issues at trial. One of those issues is whether the contract was valid and if so does Jon owe damages and if so, what. It is basically a settlement worked out with the help of a mediator. Lawyers can work out settlements on their own but I find the presence of an experienced mediator makes it a lot easier. I suppose it's still possible they will work something out where Jon will let the kids be filmed.
