Thanks Admin

I started watching and it's heart-breaking. The native community is so beaten down, full of mental and alcohol & drug problems, poverty, poor education, loss of old ways to casinos and modern temptations. The story of Darian is so sad; both the kids seem full of raw emotions and fear of disclosing feelings. Robin is a loving mother but seems lost herself although trying to help herself and her kids. Luckily there is some support/counseling available...and that's as far as I've got! It's a great doc. Donald Sutherland apparently lives quite near me!

RT @BullyVille: FYI, we do not own @lawsuitville, it was just created by Kate's stalkers. Now you see just how sick they truly are.

Oh, Kate, stop it. Just stop this nonsense. It just makes you look pitiful and pathetic.

Extreme poverty, unemployment, alcoholism, rape, sexual abuse, domestic violence and suicides is overwhelming on Reservations. What one poster (sorry I don't remember who) called Native American ''stereotypes'' are unfortunately not just stereotypes.

I think that if we had been given information what happened/Robin did when alcoholism got the best of her we might be more able to understand, and maybe even have sympathy for her actions referred to in Part One.

Holy Cow. Sorry to bring up Kate on this thread ... but I'm not a big Reality TV watcher, so I hope someone else saw this!

Flipping channels and ran into Real Housewives - I think of California?

Two blonde women talking about Alexis? - claiming she was ... wait for it ... wait for it ... BULLIED!

So, I don't know any of these people, but are they friends with Kate? Or is Bullyville helping this Alexis? chick out?

Remona, I had the exact thought watching Part 1 that we were missing the first half of the story. How did Robin get up to this point? I realize we got a little bit of background but these problems don't just crop up overnight. In a way it was a little unfair to her to dump on us an alcoholic who married a child molester and was about to lose her kids--without really fleshing out how she got here. I think most people are apt to be distrusting of her just hearing that alone. With Juanita (Farmers Wife) it felt more complete--that we weren't missing anything, this was the story we were supposed to hear from A to Z and nothing was left out. Other than wanting to know how she's doing now, which Facebook easily showed us--great! :)

Shelby, apparently the kids' father or at least his side of things brought up the filming in court or at least said they didn't like it--it's unclear what or when this was said but Robin admitted his side didn't like it or whether this played a role in losing the kids. Whether this was just a technique to try to get custody or he was sincere who knows.

I think when you make something as perfect as The Farmer's Wife it's hard to top it--that was the right family and the right time and it just all came together. I'm not even sure at this point if Robin was the right woman to profile. But I'm still a Sutherland fan and I will watch the rest of it. Farmer's Wife remains in my opinion, easily the best documentary on farming ever to be made.

Realitytvkids.com ~ Administrator said... 7

Oh one other comment, I really want to know much more about Reservation life in 2012 and I'm not really getting that. In Farmer's Wife I felt like we got a much greater sense of what life was like on the farm in 1995.

Where do you think she got the money for that hotel room? The producers? Odd.

And maybe it's just me, but if my chidren's father was a pedophile, I'd be turning them against him any chance I could! There's NO treatment for pedophiles so why prolong the kids' agony of seeing him? He's going only once place: jail.

Robin's opened up a big can of worms with allowing cameras to film her. She's got some tough questions to answer. #1 being: WHY did you let your kids live with him when you KNEW he was molesting your underaged cousin??

Realitytvkids.com ~ Administrator said... 12

Shelby, I'm with you--sometimes Robin makes it seem like she initially fought custody when they split, sometimes not. Leaves me a tad confused exactly what went on when they split. Maybe she did try to keep them away, maybe she even brought up the abuse allegations. It doesn't mean anything was done. Although I don't agree that you should parental alienate anyone, including pedophiles. If anything it's worse to do that, because it leaves kids thinking maybe half of ME is evil too maybe I'M a pedophile too. Incredibly emotionally damaging. You don't have to tell your kid their father is a saint and you can certainly encourage them to always speak up if something is wrong, but there is no need to talk badly about him. She kept saying the kids needed to stand up for themselves and speak up when their dad did things they didn't like, which is the only thing you can do if the courts have decided he can see them.

At one point he got custody after the abuse allegations came out, if I understand correctly. When that happens not sure what you can do. Keep complaining about the same things and you'll lose custody and that doesn't help anyone. The problem I'm having is we are only getting Robin's version and a sliver at that, and some of it doesn't add up or make sense (the tribe going so far as to request a no contact order then not showing up strikes me as VERY odd), several other things that didn't add up to me I can't remember now. Like I said yesterday, something strikes me as a tad disingenuous about Robin's version of the story.

Shelby said... 13

I'm aware that Robin's ex and co. didn't like her filming. Hate to agree with a pedophile, but they were right. Cameras should never have been placed in fron of Darian and her brother's faces.

I get the feeling (and feel guilty for it) that Robin is looking for a singing career and this is her American Idol 'discovery' into show business. She can sing, I'll give her that.

Realitytvkids.com ~ Administrator said... 14

I don't know what her motivations are but she does have a good voice and I enjoyed the songs. I thought it was a sweet moment when she and the kids were feeling sad and all started singing. I have to say though she's good and I love ancestral music. I do wonder why someone with THIS many problems would agree to be filmed. It seems like that's similar to what someone else said about going into a bar when you are an alcoholic. The last thing you want to know when you're having a ton of issues is invite a film crew in--that can only make it worse.

I feel like I don't have nearly enough sense from just a few hours to know what is going on with her and why she is the way she is. I am rooting for her nonetheless.

Sad to hear about the Buck Wild guy although I was pleasantly surprised that MTV shut down filming even though it seems like it was just a tragic accident that had nothing to do with the show--they make it seem like for good. Now that's respect. It would be nice if TLC had shut down filming when they realized something tragic was happening like a divorce.

I missed how she got the hotel room but I thought someone else said her ex had paid for it. It was NICE.

Then we found out later her ex had to move in with his mother. He had to be late 30's. Why was that, because he spent every last penny on that hotel room? Sad.

Why didn't she say I so appreciate the gesture but I'm not interested romantically and I wouldn't want to give you the wrong idea? At that point he could have said that's okay happy new year and good luck to you, or he could have said that's ok I'm not either I just wanted to catch up as friends and I'm happy to bring you out here no strings attached. Then it's all out in the open.

Did Robin "let" her kids live with her ex or was that what the courts decided? I am unclear on this. Clearly she fought for full custody at some point. I got the sense she was spinning it like this was their arrangement when really this was the forced upon her court of law's decision. Hard to tell, maybe in the chat with her that could be cleared up.

Shelby Robin as a mother chose not to be a parental alienator and I don't take fault with this particular aspect of her. She obviously didn't LIKE her ex but there was no need to make the kids feel badly. Many parents chose not to go there even in the face of very in bad situations and their kids respond well. The court order is usually the same whether you are a good parent or the worst one--no discussing the case with the kids OR disparaging the other parent. No exceptions. That's another thing, she very likely may be under a court order not to disparage their father even if she wanted to.

I have many questions about the entire Robin story, but the one thing I don't question at all, is the tribe saying no contact order, then not showing up. I think that it is impossible for anyone that has no knowledge of Tribal Courts and/or The Bureau of Indian Affairs to understand the complete control they have. (Not to even mention their contempt for off the Rez 'rules'.)

It has always been shocking to me the passive acceptance of wrongs done to them that I've seen/been told to me. I'm not sure how to explain it, but it seems the more downtrodden and more mistreated, the more passive they become.

Maybe it has something to do with the Indian way....Today is a good day to die?

Remona, so would this be a way for the tribe involved in the custody matter to play games or try to scare people into submission? In other words would they throw out a threat of no contact just to mess with the situation then just not show up when push came to shove? If you can, help me understand the strategy behind this.

I can honestly say I've never seen anyone request a no contact order then not show up to court to see it put in place. Or if they changed their minds on it they would still show up and respectfully ask it be withdrawn. I believe you, it's just a tactic I've never seen before.

Do I remember correctly they were saying even before this happened well, let's see if they show up. I raised my eyebrows at that--wow why wouldn't they show up? Is this like hoping your cop doesn't show up for your parking ticket?

Millicent said... 24

Re the hotel room - the ex boyfriend paid for her one night's stay, on New Year's Eve apparently. Robin said so in part 1. Then in a voiceover at the bar, says she hopes he not expecting a kiss, because that's not what she's feeling toward him. She clearly used him to have a nice room for one night.

It's New Year's Eve for pete's sake. At the stroke of midnight, if you are out with a date, it's customary to share a kiss. If you aren't willing to give your date a kiss, then you certainly should have turned down the offer to pay for your nice hotel room for that night.

I think Robin's hard life and extreme poverty lead her to make choices that most of us would think are questionable, including acceptance of a hotel room from an ex, guilting her biological dad into loaning her money, etc.

One thing I thought was possibly not the full truth is she claims that while she had her two children, they missed "a couple days" of school to attend doctor's or counseling appointments. Supposedly, one of the reasons they removed the children from her care was because they were missing a lot of school. So it's unlikely they missed just two days; and furthermore, most doctor's offices and counselors will gladly work around a child's school schedule. They can make appointments for after school hours. I also didn't understand why Robin would have to leave the kids alone to attend an AA meeting - wouldn't there be a daytime AA meeting that she could attend while the kids were in school. Maybe even one on her college campus?

I agree that we are missing a lot of pieces, so it's hard to make a judgment call. All I know is that I do hope Robin can become successful, earn a decent income, and care for her children and provide them a stable and loving home. Those two certainly deserve that.

Another, thing is we should stop (I'm gonna) posting any comment to Kate blog over at the Stir, or any place else (articles about her) and especially twitter). I understand this was done a few months ago and Kate twitter was very dead.

Kate thinks all of these tweets are gonna get these people to buy her cook book, most of the ones that are twittering are fly-bys, one time posters, like when you go on some chat board and say: hey were having meetup at a certain mall to do a 5 min dance, and 100 people show up, that is what is happening at Kates twitter. it is sad to know that Kate has to be this desperate to stay in the media, though this will backfire. Stay safe people, and ride the storm out!

And this I find odd--in the same hearing the judge is deciding between a no contact order and RETURNING CUSTODY TO HER??

What?

It's pretty hard to go from a no contact order to full custody in ONE hearing. In fact it could take months or years to recover from a no contact order if you ever do.

That's why I said this doesn't make any sense. This is very eye opening. Sometimes things that don't make sense are reality anyway.

A little off topic but I guess when God picked moms he wanted to have 6 babies at once, he made sure they were all OCD.

Watching the Mc Gee's and Mia is somewhat like Kate but nowhere near as bad. This woman can be OCD and still come across as a kind, decent person who loves her husband, kids and extremely appreciative for all the help from family, friends and volunteers. She actually opened her front door to a volunteer, gave her a big hug and welcomed her without doing a lie detector test and urine screen, lol, imagine that.
There house is really nice and looks big enough for all of them. I think her MIL lives with them. Kate would have murdered hers in the first week.
I like this family, the kids are so cute and she even dressed them first and fed them breakfast in their good clothes. Kate would freak out. I wonder if she every watches the show. Would love to see her expressions and hear her comments while she's watching.
Oh, now she is letting church members carry some babies out of church because they were acting out. Kate would just twist an arm or pinch or something, right there, in the house of God.

I totally agree 100%. Had the same thought! Huge oddity and red flag. The school itself usually has a truancy board and likely would have whipped her into shape long before this ever reached the custody courts. I heard they will even come to your house and help you drag the kids to school. If they truly missed it for counseling (and why did they need to miss ALL day for a counseling appointment? Why couldn't they at least do a half day) then she should be able to document that with a simple letter from the counselor and that takes care of that. I found myself practically saying no Robin you are not losing custody of your kids because they missed TWO DAYS of school, come off it and be honest.

Did you catch the part where she said the lawyer put ANthony on the stand and was poking holes in her story and she felt bad? I thought that's what she was alluding to. It made me wonder what does she mean, that Anthony had some story different than the "truth"? And what story was that and why would a boy who clearly adores his mother make such things up? He seems otherwise very open and honest about his emotions. Lying does happen sometimes but this part was still a red flag.

The more I think about this the more I'm wary of this woman and her story, though I really don't want to be.

Meagler said... 30

In it she says that she will always come out and deny those stories online that are lies, because she can never leave a lie out there for her children to see at some future date.

Realitytvkids.com ~ Administrator said... 32

I'll say this--One thing I have noticed for some people knee deep in Robin's situation is there is a "culture of lying." These people lie for no reason sometimes, Robin probably got so used to lying as a kid in foster care--about abuse, among other things, and then lying during her drinking episodes, it may be so second nature to her to tell lies, even little white ones. She's not necessarily a bad person, this is part of what she is used to in order to make it, for many people truly a way to survive. I got a strong sense Robin may be trapped in a culture of lying. She depresses me.

I think Sutherland likes to hit a nerve. That's his style. He finds the most downtrodden stories and then creates feasts of film out of them. Here I thought I was gonna see a fun show. What is it about kids that make us think that they are not people with feelings until they are about 5 and THEN we realize that they might take issue with being so exposed. UGH. I liked this family, but Lord help those children!!!

I've never heard the Reservation having a truancy board, no idea. I thought their absences occurred when they were living in Fargo and going to public school. After I lost my daughter, I decided to get 10 of them, and had so much fun shopping for things to put inside of them. It really helped me get through the Christmas season that year. I decorated the insides of the boxes with bright pictures of animals, but never thought to write little messages in them. That was so thoughtful of you to do.Even though this blog is about kate, I have learned so much from posters like you, making me be a better human being. Remona B - thank you for your input, it is much appreciated. I don't know much about life on a reservation. I live in California, and we have several tribal reservations north of my home town, that now have casinos on them. But that doesn't mean anyone gets to see what reservation life is like.

I had a friend who was part Marongo Indian (I believe). Her family lived on the reservation down near San Bernardino area. I visited her once during a school break. She explained that I shouldn't wander off from their home on my own - as in, talk a walk for exercise. That I was allowed on the reservation only because I was their guest, and it would be best to just stick close to home. That was fine with me. I don't remember much, but their home was very nice. Her dad was Indian and her mom was white. They seemed happy. She didn't say much about living on the reservation and seem to have negative thoughts. The main thing was just to be sure to always be with one of the family, to avoid any problems with being on the reservation.

It seems like that's similar to what someone else said about going into a bar when you are an alcoholic.
--------------
There are many recovering alcoholics who own bars. As a matter of fact, when AA was in the formation stage, it was a common practice to go to bars and 'kidnap' an alcoholic. It is a core value of the program that reaching out to alcoholics helps keep me,bers sober.

There was a documentary released last year, called Bill W. (founder of AA). I saw it in a theater, and it is available for rental on Amazon Instant Video. I highly recommend it to anyone who wants to understand alcoholism Also, Bill W was a fascinating person--a lot of the movie was re-enactment of scenes from his life story narrated by Bill himself, as he told his story at a dinner. I highly recommend it.

There is a different movie called My Name is Bill W. haven't seen that one--it is quite a bit older.

OT:: I watched DWTS. I thought it was a good results show with quite a few funny parts. No spoilers!
OT:: I listened to TMZ live on the way home, they interviewed Shain Gandee's cousin who is putting together a fund raiser of mud bogging to collect donations for his funeral expenses. The cousin said the family does not blame the show or MTV for what happened. She said that what you saw on camera was the real Shain, that he was the same if the cameras were on or off him, and the mudding or mud bogging was something he did long before MTV came calling. Its very very sad, carbon monoxide poisoning can be prevented.

I recently attended an open AA speaker meeting that featured a Native American speaker. He said, " when you live on an Indian reservation and people tell you that you are a drunk, that's really saying something." his story was incredibly inspiring. He lived in a group home until he was 16 until he was imprisoned for assault and burglary. He got his high school degree, and eventually was admitted to Harvard. He earned a Ph.D and has held several very high-profile positions as the director of various treatment centers. Best speaker on the subject that I have ever heard.

The pressure on Darian during this court trial is insane. To add cameras to the situation must be paralyzing for her. I'm not impressed, Mr. Sutherland.

I just caught up on the previous thread posts. The reason that the haterz don't stop tweeting is because they can't (IMHO, of course). This has become their purpose in life--the bringing down of a washed up z-list celebrity. To back down now is admitting defeat. just a matter of time before they all form a circular firing squad and all fall in a lifeless heap. We are witnessing true insanity.

There has been so much hyperbole on both sides that I can't even come up with big enough words to describe my shock.

Did anyone catch Robin's attorney saying that the Tribal Court had ''lost'' the records? I'm going to watch the last hour again, but Robin going back to the Rez will probably not end well.

Once again...it's very difficult for outsiders to understand the pull of the Rez to Native Americans. Just as you think one has 'escaped' and will actually succeed, there they are again. In the very same place, the same people, the same conditions that cause all the problems in the first place. The more downtrodden some get, the more passive they become...then act out in self-destructive ways.

I've got to stop posting about this...at least tonight. I need to give myself some space to chill out!!

Ok...wait a second here...Robin fought to leave her Reservation, finally does it, meets a man and moves to HIS Reservation? Where she's completely dependent upon him, living in HIS house, moving to another country and dealing with HIS family crap? This woman is really dumb.

Don't even get me started on how she completely DITCHED her medical bills in Fargo. Craziness.

Realitytvkids.com ~ Administrator said... 62

This woman needs help. She shouldn't be laying all her emotions about the kids being in foster care on Darien. It's hard enough being a kid in foster care not to have your mom in an emotional wreck over it.

And the comment about how social workers did nothing to help her seems like it could be libelous.....really, the entire case they never did ANYTHING? Or is it just that she didn't like or want the help? What did she do when the social workers weren't "helping"? Did she call them? Did she call a supervisor? Bring her complaints to court? She is hard to like.

Did you catch her boyfriend is a CPS worker? Is that how they met? Coincidence??? What is a CPS worker doing with a documented child abuser? This whole thing is very suspect.

Bullyville tweeted,

After seeing death threats, pedophilia claims, theft & documented stalking against @Kateplusmy8
& fans, we've decided to file a class action lawsuit against the
main offenders. The evidence is overwhelming and the victims deserve
justice. If you'd like to be a part of this class action lawsuit, please
email legal@bullyville.com.

Now I'm really confused. WE? Who is doing the suing? Bullyville and the fans? Are they suing on behalf of Kate, who claims to be the victim here? Would Kate be the lead plaintiff, or would Bullyville? If it would be Kate, would she, along with others in the suit, have to assess damage? Can Bullyville be the representative plaintiff if "it" was never part of the alleged harassment?

And who is paying their attorney?

Realitytvkids.com ~ Administrator said... 65

Shelby the cameras weren't in the courtroom just filmed from far away outside on the steps. That said, no they shouldn't have filmed Darien.

It kinda bothers me when child molesters amass this whole motley crew of supporters even if it's family. How do they know for SURE what happened? At most you should say hey I wasn't there I don't know.

My brother and sister in law adopted 6 Native children. They could write a 5 volume series on that. One of their children decided to return to the reservation of his biological family as soon as he was an adult.

I will never understand who these children are. They won't talk to anyone except other
Natives. They have been raised in what is called "a white man's world", but don't really fit into it. They are psychologically and socially different than any other people I know, including other Natives.

This whole thing is a tiny sliver of a peek into life on the Rez. Things are not done there the way they are outside the Rez. To expect The Tribal Court or anyone else (the Social Workers, for example) to behave in any logical way that we expect outside is an exercise in futility.

The Reservations are a different world. Outsiders, even the ones that are very informed, those who care deeply will never understand. Even Native Americans that weren't raised on the Rez will never understand. The Rez has almost a mystical pull for those who were born and raised on the Rez.

Way too far. I didn't see the death threat. Was it made from a hater to a fan? Was this a recent threat?

Someone commented about one of the haters who was outed, asking how it was possible for someone to tweet as much as was claimed...how someone could have 72,000 tweets. That person isn't tweeting to Kate any longer, but I noticed that she's been at it for 14 consecutive hours. There's something very wrong there. It really is an addiction, and it's not about Kate or the kids. My gosh. Go out and read to kids at a library...get involved in charity work...take senior citizens on a field trip -- SOMETHING!

Shelby said... 75

Don't stop posting Remona! I need another opinion here 'cause although admin and I don't see eye to eye on how to handle the pedophile dad issue, we seem to agree on everything else.

Notice how Robin DID have to end up facing her creditors so that she could receive....MORE financial assistance.

Wonder how much she was paid to be filmed? Does Sutherland do that? Because I can't see any other reason she would want all the dark, dirty laundry of her life out there.

Those poor kids. The little guy, Anthony, looks to be suffering greatly what with his emotional outbursts and anger.

What was Robin thinking would happen when moving the kids around so much?

Realitytvkids.com ~ Administrator said... 76

I'm sympathetic to Reservation life being terrible but so many of the things she does have nothing to do with the Reservation. Let's take skipping out on her bills. I get it, she has no money for them and she's in deep trouble. But skipping out is not the way to deal with it. That's not what you teach your kids. She does strike me as not very bright. As if in this day in age you can skip out on bills. It's going to catch up eventually and by that time what credit she has will be trashed to smithereens and the bills could be even worse. She is not making common sense choices that would help her get out of this situation. She just keeps getting deeper. And sure enough the place where she worked offered to do whatever they could to help her with her bills. There are many other ways to deal with it. HOW many times has she moved the kids in three years? I lost count. The Farmer's Wife family had just as little but at least they made stability a priority for their kids.

Lying to Border Patrol--very nice. No passports in Canada which now requires them. Double nice. She's afraid the Canadian authorities are going to get suspicious she's kidnapping the kids-- um, because she IS?? You realize that's what is going on here, KIDNAPPING. I guarantee she's not supposed to leave the county. Wonder if Sutherland was at all worried he could be implicated in aiding and abetting.

I don't like that Darrin discouraged her from getting more hours at a better paying job and wanted her to take a lower paying job. WHY? Why discourage her from doing something she likes that pays well? He doesn't want her to go off to work because he might lose her to another man. That has nothing to do with the Reservation either. Nope, not a good guy, sure enough. Ugh. And why in the world would CPS hire someone with such an extensive child abuse history even as a secretary? Are these people dreaming?

Part 2 was ten times worse than Part 1. It got way worse not better.

Now she wants to mooch off Canada to have the good people of Canada pay for her kidnapped children to go to school there, and if that doesn't work she wants DARRIN's tribe to pay for it when they are not members of THAT tribe, totally different tribe. Good grief I HATE that attitude. I come into your place illegally and uninvited but you should pay for me.

Lost the records, now that one I HAVE heard. lol

Whew, not expected at all.

shame in having others support you, no shame in just taking what you need. It's an attitude that gets passed down to the next generation.
I am not at all surprised to hear she skipped out on bills and expects the Canadian government to support them. After all, in Canada, if you are a Treaty Indian, you DO get supported. My nephews and nieces are. Free
college education (which they did not take advantage of and all work dead end jobs, if they work at all.) Years ago the Canadian govt.
decided to make amends with its Natives by offering them lots of perks, at least if they are Treaty Indians.

Shelby, I could talk till I'm blue in the face, but since Robin is Native American, and obeyed the pull she had to move back to the Rez, it will NOT make sense to any one other than someone that was born and raised on the Rez.

Actually, Robin has been able to find employment, and figured out how to jump through enough hoops, she is MUCH MUCH better off than most on the Rez. It is even worse for men.

Even though I don't like the expression ''it is what it is'' (and find it trite)...that is all I can come up with. Anything else would be involve a much deeper discussion and would get into over-sharing, and that I'm not going to do. Sorry.

Realitytvkids.com ~ Administrator said... 84

I wonder how that live chat is going to go with Robin on Wednesday. We can't be the only people a bit irked by some of her choices. She lost me when she so callously said she ran out on her bills. Oh boy did she lose me with that. I think we're the wrong group of people to talk to about not making your own way and paying for your own family yourself. :-)

Yes Shelby our bullshit meters were working well yesterday, many of you must have had yours fine tuned over the weekend! This woman is FULL OF IT and we called it. I guess I mostly just find it frustrating the attitudes that make up this woman, and we can get into the sociology behind why she thinks this way, sure. I do believe she genuinely loves her kids but as far as getting her life in order she's a failure. School was a mess, she was stuck in a huge custody battle, she's with one bad man after another, she's a tease to the only decent guy in the bunch, she skips out on creditors, lives in poverty, cant keep the same house, she crosses borders illegally then wants them to pay for her kids, and for good measure she had a drinking problem. What a mess.

Yesterday however I thought the stereotypes comments were a bit exaggerated.....today I have changed my mind. They are playing out several prevalent stereotypes embodied by Native Americans and this is incredibly mortifying and a disgrace. I'd be really curious if the tribe has any comment on this. What a PR mess. Heck I can see some viewers coming away from this thinking some terrible things about Native Americans.

I'm too tired to finish part 2 only halfway through. Will finish it later. Goodnight.

There are many recovering alcoholics who own bars.
* * **
I assume this is anecdotal, unless there has been a study done on recovering alcoholics and the businesses they own/employment they have.

I know a number of alcoholics. They call themselves alcoholics although they have been sober for many years. This is anecdotal too - but all of them say it is best to avoid situations that might cause them to relapse, because their recovery is so precious to them. One works as a counselor for former military and also as a counselor in an alcohol rehab program. Another has sponsored a number of other alcoholics working toward recovery, and loves visiting Starbucks but wouldn't step foot in a bar if you paid her a million dollars. The third is my son's father - he says it doesn't bother him if people drink in his presence, but he doesn't want it in his home. He too stays away from the bar scene. A fourth is a local D.J. in the Bay Area who talks frankly of his past alcoholism. He seems strong in his recovery, and when the group (two lead DJ's and their assistants) take trips with fans to Las Vegas or Hawaii, there are plenty of people drinking a lot of booze all around him and he can remain sober. But he doesn't spend all day in a bar either.

I used to have a little gambling problem. Having a child solved that. But I still can feel the allure of those ringing machines and I sure wouldn't want to spend every day working in a casino situation. It's better to just stay away.

Remona - I know you are frustrated. I'm not sure if you are frustrated because we (well, me anyway) can't really understand what you are trying to say, or if this program and our comments are bringing up too many unpleasant memories for you. I hear you saying that unless a person has lived on a reservation and lived this particular experience, then they cannot really grasp why a Native American might behave a certain way. That there are layers to this life that we just have no concept of, nor can truly understand.

Thank you so much prairemary on your post about the shoeboxes. I am so sorry you lost your daughter. So happy that you decided to honor her in doing shoeboxes to help you get through Christmas that year.

I did my boxes in honor of my first grandson due next month.

I managed to make several boxes this past Christmas with things that I had saved over the last couple of years. Since I live in a Nhome, my friends helped me with washcloths brand new, tooth brushes, toothpaste, the kidney shaped pink bowls that they can use to put the high protein mush in.

What is amazing is getting a letter back from a child that received a box. I just read yesterday on OCC Fbook that a older man and woman who had did shoeboxes 3 years prior got a letter addressed to Grandma and Pappy? They were thinking, what? Who is this from? They had forgotten about making the shoeboxes and it was from a child that had gotten her shoebox 3 years ago!

The reason why it took so long to get the letter was because the child saved her money for 3 years to pay for the postage to mail it! It is very rare for someone to get a letter. In 10 years, I have known only 2 people in my district that received one.

I would put the money and self addressed envelopes in the bottom of the box under a coloring book.

Reminds me of a man who was in a cult years ago and he wanted to go home. He would walk around the compound and find loose change and bought a stamp for his letter to his family. It took him 6 months to find the money.

I didn't get the chance to do it this past time, but it would be great to have a couple of envelopes addressed and a little money put with it so they could get the postage for it.

Hopefully, I will be able to go back either today Wed. or Thursday. Yes, I am still in the hospital.

Can't watch KHW. I am exhausted just reading the rollercoaster life that Robin lived.

So what legal right do they have unless they are acting on her behalf? And wouldn't Kate have to prove that she has taken prior action against the bullies such as contacting the hosting web sites or police to file a suit as a last resort? And Bullyville's tweets are threats so are they not coming to court with " clean hands"? ( I watch Law and Order and Judge Judy, he he). Is she paying them to act as her agent in this whole mess? Bullyville says follow the money trail.

How does a class action lawsuit work? I don't know if Bullville can actualy file it because they would be the 3rd party rather than one of the plaintiffs or would James be part of it?

Plus Kate and the fans are from different states/countries, so how do they decide where to file the lawsuit if they get that far? Would it be filed where Twitter is headquartered since the communications were sent through Twitter?

Realitytvkids.com ~ Administrator said... 106

I think they're confusing what a Class Action Lawsuit is. Do they have it backwards? It's not when you sue a bunch of people (haters?). It's when a bunch of people sue one person or entity. Who is the one person or entity they are suing? How do they figure they even have standing? You have to be the one harmed.

I assume the booth was shut down. I heard nothing about her publisher getting upset with her about it.

I don't remember ever learning about this but apparently you CAN have a group of Defendants be the "class" but apparently it's only done in rare circumstances. According to Wikipedia:

Defendant class action

Although normally plaintiffs are the class, defendant class actions are also possible. For example, in 2005, the Archdiocese of Portland was sued as part of the Catholic priest sex-abuse scandal. All parishioners of the Archdiocese's churches were cited as a defendant class. This was done to include their assets (local churches) in any settlement.[9] Where both the plaintiffs and the defendants have been organized into court-approved classes, the action is called a bilateral class action.

I think it would be hard to define this lawsuit since each person's claim of harm would be different. I can't see a lawyer saying this is worth the time or expense. I know, why don't you block people on twitter bothering you? I know, if someone makes a threat against you why don't you call the police or go to court and obtain a restraining order? Seems simpler.

Thanks, Admin. It made no sense to me. Actually, I would think those who have been harassed by Bullyville with an outing, particularly if unfairly accused, and the unheard of calls to employers, would have grounds to sue.

Novel Rank is not always accurate. My friend has written a few books and she said Novel Rank rarely matches her actual sales. Last month she sold about 30 copies and Novel Rank showed only 8 sales.

Well I think Kate has herself backed into a corner. She has been so busy re-tweeting all of Bullyville's tweets but has been oh so quiet since they announced this crazy idea of a class action lawsuit. She is going to have to address this one way or the other. But she will probably say she is not a party to it, but agrees that something must be done.

MJ, I am speechless. When I first started reading your post, I started to water up and took my glasses off and put my hand on my face and was about to cry.

I am at dialysis in the hospital right now and the nurse said, what's wrong? I said it is all good.

There are a lot of strong women on this blog and I enjoy reading and posting. I know sometimes my posts are kinda scatterbrained, I jump from one subject to the other on a dime! lol I can't help it! lol

Forgive me for my scatterbrained grammar and sentence structure. Guess I will get happied up by kate for my English problems! lol

On KHW, Why was there such a nice hotel room for one night? I would of went to a nice place but cheaper. The rate was probably higher due to NYEve. She could of bought food for her kids.

Got awaken this morning by lab work and the Duggars were on tv announcing baby no. 20. I think the parents telling the children that their sibling had passed away should of been OFF CAMERA! It was also to me, staged and scripted. Also they showed the big announcement of the baby on the Today Show and someone said that one of the middle to upper boys heard it and ran off the set to the side.

Run Jinger, Run Josiah!

I didn't see it happen, don't know if they edited it out or not.

Hoping and praying that Anna has her baby in a HOSPITAL! How she has survived giving birth the way she has, it is a miracle that everyone is ok.

Talking about the fried processed foods for 25 people. Could they not of smoked some turkey or chicken, grilled corn on the cob, hot dogs and all the works instead of heat and eat?

Interesting, this is still being ignored except a few rag mags and sites and a couple of those "self-published" article sites. That's just indicative that really, no one cares about it and just supports that she's not relevant. Relevant maybe to a small and pointed group of tweeters on both "sides", but in the overall scheme of anything news or entertainment worthy, she just isn't rating attention anymore.

I see, but why would Bullyville be involved in a lawsuit when the harassment was directed to Kate? Why would they be a plaintiff to begin with? I am convinced she and Bullyville have entered into some agreement otherwise why would they go to expense of a lawsuit. To me, this reeks of them acting as her agent and they are not doing it for free. Right? How do they make money? Ok, my head is spinning.

Mr. Bullyville man seems to have an ego of equal or greater size than Kate. Demanding apologies, threatening lawsuits, showing off his tattoos (how is that relevant to her plight?). Next he'll want everyone to write down ten reasons why Kate is a lovely person. Has he met her? Maybe he should spend some one on one time with her before he goes all lawsuity.

She is evil said... 121

Kate could be a defendant in a class action lawsuit. Just think of the people she has abused and stolen from: her children, Jon, her parents and siblings, in laws, friends (once upon a time), love offering donators, fans who watched her fake show and bought her dumb books, corporations who donated products to her, the state of PA for paying their medical expenses when this whole HOM thing was Kate's own doing, TLC for supporting this POS until she finally wore them out, her blogging employers who paid for her unprofessional, stupid articles, Rock n Roll and her (suspected) faking of her marathon run, women everywhere for pretending she simply de-ages instead of owning up to all that money she's wasted on plastic surgery for herself. She has bankrupted the father of her own kids. She imprisons her children and forces them to work ion and off camera. She tries to project this image of an involved mom which is a fraud. Such damage from one person who's life goal was to have a litter of kids for the cash and prizes. Can we sue?

http://radaronline.com/exclusives/2013/04/kate-gosselin-class-action-bullyville/
The battle between Kate Gosselin‘s fans and foes is headed to a whole new level — and possibly soon, a judge’s chambers.

James McGibney, who runs the BullyVille website, announced he’s heading up a class action lawsuit against a group of people he claims have made death threats, bullied, stalked and harassed Kate and her supporters online.

“After seeing death threats, pedophilia claims, theft & documented stalking against @Kateplusmy8 & fans, we’ve decided to file a class action lawsuit against the main offenders,” James tweeted from the Bullyville handle Tuesday. “The evidence is overwhelming and the victims deserve justice.”

It is not yet clear if Kate will be a plaintiff in the announced lawsuit, though an insider tells us McGibney does indeed have legal standing to bring this type of action without her, as some in the anti-Kate consortium have threatened his life, with one even accusing him of hiring someone to kill her.

It is not yet clear if Kate will be a plaintiff in the announced lawsuit or if McGibney would have legal standing to bring this type of action without her.

Oh man what a mess! They're going to sue Kate's haters. What about the other celebs they claim to protect? Are they going to sue on behalf of the Kardashians? Leann Rimes? Brandi Glanville?

Does Kate not realize that this is damaging her "brand"? That she's coming out of this looking not like a hero for standing up to bullies but as a pathetic, washed up reality star who has to resort to junior high antics to stay in the spotlight? As most people here have been saying for months/years, if Kate is feeling threatened, take her Twitter private. And if she is truly against bullying, then she needs to call out her fans who have spewed hatred and "death threats" against Jon over the years, because her "fans" have been just as vitriolic towards him as anyone's been towards her.

I don't see a judge taking this seriously at all. Through her lack of judgement, Kate has allowed this website to use her "fame" to promote their own agenda. I think it's time for these people who are being threatened with legal action to turn this around and file a suit against both her and Bullyville.

If Kate truly feared for the safety of her children and herself, she'd shut down her twitter NOW. Bullyville is antagonizing people who already don't like her; who
knows how they'll react when threatened? So this is where we separate the women from the girls, Kate. Which is it? Do you choose your children's safety or your need for attention from faceless strangers? Your choices are simple; I guess it's the decision that's so hard for you. Hmmmm

Realitytvkids.com ~ Administrator said... 128

Are they like Westboro where they goad and threaten and get in your face until you snap they then sue you? Maybe that's how he makes his living, people settle with him to make him go away. What a mess Kate got herself into aligning with them.

What is "document stalking"? I didn't know a piece of paper could be stalked. While I don't think we need to know of many of the pieces of information out there about Kate, as long as it was obtained legally, I'm not sure if he has a horse in this race. The problem too is he is talking about a public figure. Kate chose to be a public figure which means it's going to be harder for her to sue than it would be for a private person just trying to live their life without being harassed. The public has a lot more interest and right to information about them when that happens. For instance, crying poor to churches while signing a contract for thousands of dollars for a weekend's worth of work is a matter of public concern. I can't see any judge finding a single thing wrong with exposing that info. But if it were just some private person's contract and someone published it for no reason, there might be a case. That simply wasn't the situation here. Same with information about their house....trying to maintain this blue collar appearance on TLC while raking in millions, turned out none of it was going to the kids. A matter of public concern once again.

Realitytvkids.com ~ Administrator said... 132

LB all questions that make this so unlikely to ever get off the ground. Also who is paying for it?

My biggest question too is what is the harm? You have to show harm. Are they trying to say they were libeled? Emotional distress? All things difficult to prove. And all things very case specific which is why a "class" makes no sense to me. "You hurt my feelings" is really not enough to show actual harm.

Also the first question I would ask is, Ms Gosselin, if someone was threatening you and you felt truly harmed, why didn't you contact the authorities? Could you please present your police report to the court? There goes their "harm"/emotional distress argument if they didn't even feel threatened enough to phone the police. Over and done.

I echo comments about them poking clearly unstable people. I think it's a bad idea, even dangerous, to poke such people. It's more scary to do it this way then to just quietly call the cops and quietly serve them with a restraining order off Twitter.

Lukebandit, I saw the episode where the Duggars announced baby 20, and Josiah ran out of the group like he was going to throw up. His face was all twisted and I felt so bad. The next shot had Jim-Bob holding him and he looked so sad. Now he seems to be toeing the line again. Must have been sent away to be re-indoctrinated. He does wear a lot of pink and purple and bow ties and stuff. I am really surprised they allow it.

As far as Kate and the book goes, I just don't think people are willing to put up their hard earned money. They are interested to some point, but want to read about her for free. And they just want the dirt, not unicorns and butterflies.

I've been thinking a lot about this comment and I think this is why Juanita from Farmer's Wife was a modern day feminine hero, and why I really don't like or feel sympathy for Robin. I guess arguably Robin's situation was worse with her history, but Juanita's was pretty darn bad too and there were shades of DV going on there too at least emotional ones.

Juanita was DIRT POOR, I can't remember the exact figures but it was clear they were in deep holes. But Juanita didn't skip out on her creditors. Juanita in fact over Darrel's objection went into the creditor's office and groveled for payment plans and extensions. She took the bull by the horns and FACED her situation.

Juanita also didn't quit school. She stuck it out even when it was hard and exhausting. She too also had her kids with her but she didn't blame them for being late or missing homework. Juanita didn't quit her job. She stuck it out and moved up. Juanita kept her family together, in the same place, at the same school, and even scraped together a couple bucks to throw them a Halloween party with friends. No excuses ever. Juanita also had inlaws and family that didn't like her, but instead of battling it in court, they went to mediation to work it out. They worked it out in a productive way. (Remember that?)

Two women, two approaches to very dire circumstances. Juanita gets all my sympathy because Juanita was doing everything she could to right her situation. And today she is apparently doing very well, she has crawled out. Her kids seem to be doing great and the oldest is engaged by the way!

I just can't feel that way about Robin. She hasn't done much to show she is taking active steps to do better. She just slips further behind. I think this documentary would have been much more compelling had she been more of a Juanita character, more of a go getter, more of a facing up to her problems, no more excuses. I think the casting was very misguided. However I guess you never know what you're going to get when you cast and then film for three years.

I just don't think very many people would even bother with cookbooks these days when excellent versions of any recipe you can possibly think of are available online. It's not like they are lower quality. They are just as good.

admin~ In answer your question at 140...it depends.

Publisher's Weekly announced the top 10 best-selling cookbooks of 2012 this month, and we have to say, it made us feel feelings. Just to be clear: we're pretty happy for anyone who gets a cookbook published, but we definitely had our favorites last year, and were sad that none of them were on the list.

Barefoot Contessa Foolproof by Ina Garten topped the list at 428,105 copies sold. Also on the list two cookbooks from The Pioneer Woman, Ree Drummond, and one from Deb Perelman's Smitten Kitchen. Which, we suppose proves the power of the food blog and the power of the celebrity chef again. Paula Forbes over at Eater totally nailed it: "It makes sense: popular but not overexposed food celebrity publishes a collection of recipes based solely around the concept that you cannot mess them up? Yep, that's going to sell."

Below, you'll find the full list of best-selling cookbooks, and then you can check out which cookbooks we think should have been best-sellers, just because.

I don't see how any of this will end well for Kate. It’s too late for Kate to go on twitter silence and disavow any and all knowledge of what’s going on because she’s been egging bullyville on since all of this started by re-tweeting their threats and telling them that they’re her heroes. I can see the headlines now…”Reality TV Star Sues Critics and Non-Fans”. Those that are taking part in this suit had better watch out because many of them tweeted very vile things to Jon and Kate gleefully re-tweeted many of them. I’m sure that screen captures exist of those tweets. My advice to Kate is to drop the stone now and don’t throw it because she is not without sin. Unfortunately it may be too late to sever her ties with BV so I guess the stone can’t be un-thrown. Not that this class action suit will go anywhere, but does Kate really want all her dirty laundry aired…especially if Robert is brought into the suit? I think not. I wonder if Laverne & Shirley are still in the picture and if they advised her against this alliance with BV. Mr. Bullyville is an ex-marine who is no longer in the Corps and has to have somewhere to rattle his saber. He is using Kate. Semper fi? I don't think so.

I think cookbooks from well known chefs and food bloggers will continue to sell, but people like Kate, with only her self-perceived popularity, and a negative one at that, will not be successful. Her pitiful pre-order sales is indicative of that, and indicative of the 'real' number of followers she really has. If her Twitter number was real, her sales would be higher. Her ego has exposed her to the awful truth, something we have long suspected. And this Bulleyville association can have no good outcome for her, none.

I'm not saying that a majority do, or most. I am saying that it isn't a foregone conclusion that because someone is an alcoholic, they would never own a bar--or restaurant, for that matter.

My point is that everyone decides for themselves what is appropriate for their recovery. And, my comment about the origins of the practice of going to bars to find alcoholics for the purpose of maintaining their own sobriety is well-documented in AA literature.

The goal of 12 Step is to restore your life. Alcoholism is a disease, like diabetes, or allergies. Some people with diabetes won't go into a bakery, either. It just isn't a given that alcoholics set up their lives so that they never have to be around alcohol. That is what the co-dependent people in their lives do--try to control someone else's drinking.

However, many find the companionship that they were looking for in bars exists in AA meetings, with their fellow alcoholics. There is a lot of fellowship (socializing) after meetings and there are meetings almost every hour of the day.

Anyone who is interested in finding more out about alcoholism can attend an open AA meeting or speaker event. There are websites that list meetings in a given area, and there is always a designation whether it is an open meeting that is open to anyone with an interest. Speaker meetings include a member or two telling their story and how there life changed.

I wonder if Robin is using her past as a crutch never to better herself.

It seems like we're always hearing from her, I can't do this or that because I am a DV victim. I can't do this or that because I was molested. I will always be depressed for the rest of my life because I'm a DV victim/victim of molestation. I can't have a good relationship because I'm a victim. I have to move because I'm a victim.

At what point are you really a victim and at what point are you just using it as an excuse? I think not only does she disgrace Native Americans but she disgraces other victims who have been through similar situations and risen above it.

I do like the Santa with the Fargo accent. :)

Boo, apparently it's so obscure that we never even learned about such a reverse situation and of course we did both study class actions in Civil Procedure, a standard topic everyone learns. Apparently it DOES exist but I haven't had a chance to read all the rules required to form the class. We actually were required to read the book A Civil Action which I think is about that drug that caused miscarriages?? I can't remember now. But that was a big group of plaintiffs against one company.

You can't just say, okay this is a class action. There are very specific rules you have to meet. Rest assured it will be very costly and complicated though.

As someone who's been in the legal field over 25 years, I don't get this supposed class action suit at all. What are your damages? How are you going to prove damages? If you prove damages, who exactly is going to pay for your damages? If you are claiming legitimate death threats and stalking, that's a criminal matter, not a civil class action suit. Class action suits are HUGE money makers for the lawyers that bring them. I can't imagine a true class action attorney touching this with a ten foot pole.

That may be, but Robin was in no fit mental state to be waltzing into a bar on New Year's Eve. She can decide for herself but she has proven over and over to make the absolute WORST decisions. She was slapping & pulling away from him while he was telling her he loved her & making faces during their wedding ceremony. Do you think it has a chance of working????
Darren seems to be a good man in many ways, but his jealousy & VERY laid back demeanour would be hard to take.

She uproots those kids just as they start to make friends in each dead end town they find themselves in, then ends up back at her reservation, where all of her unhappiness started. There didn't seem to be any support for her there, so why go back?

I was getting pretty dozy near the end & couldn't keep track - did Darren go to the reservation with her? Or are they separated?

I am not disputing this -- merely saying that in my own (admittedly rather small) personal experience, none of my friends who are also sober alcoholics have ever done such a thing. In fact, it's pretty well documented that recovery has the best chance of being successful if the addict makes the decision to seek help, rather than being approached while drinking heavily in a bar.

Just like with any addition, the person with the addiction needs to come to the conclusion that they want to change. I think outreach programs are critical. My one friend who works at a substance abuse center (it's not a rehab, but more of a counseling center, helps direct people to rehab centers, help them on their road to recovery, staying sober, etc.), does a lot of community outreach. However, she never goes into bars to do so. She goes on base for regular open meetings, and military people know that if they want to seek help, they can show up at one of those sessions and get information. She was an alcoholic for many years, yet functioned well in the military. So she has a good rapport with military people, because they know she's been in their shoes.

Anyway, I'm not picking on you for that statement about recovered alcoholics owning bars - it was just the first time I saw it, I read it to mean it wasn't unusual for alcoholics to own bars. The only one I ever saw was Sam on Cheers.

I got to watch this documentary about Robin....thanks for posting it..I came by here to get Kate Gosselin update but this was way better then that twitterpalooza going on

I was struck by the little/big issues here....

1. Robin tried to rebuild a life but seemed almost stubborn about getting a job...like she was only gonna work in the domestic abuse job field...if my kids had to eat I would work whereever gave me 40 hours a week. I know it showed her doing a maid job....but wouldn't a schedule have been better then having so much time at home and having to depend on donations from boyfriends, dad, etc (kinda made her to look like a moocher)

2. Robin sure moved those poor kids alot

3. Robin seemed to have an honesty problem too...did anyone notice the boyfriend ask her about her dating another man when they broke up...she never answered him...

4. On a positive note...I liked hearing about the family meeting with the rock, the journaling she encouraged, and the compassion she showed her kids on camera....I don't think that was fake at all. It's like she listened to the counselors some and tried to instill it

I think anyone who is violated as a child in anyway that causes trauma (look at how Kate Gosselin has shown how scarring emotional trauma to children can be) helps make it all the more harder to forge on an adult life...and maybe I misunderstood this mom but she sure seemed through the photo lens to be so many contradictions...and maybe that is what the lesson is here...

I've been lurking for a while and while I don't care to comment on the Kate fiasco as I think all will end up as it's meant to, I will make a suggestion for a great PBS series to watch: "Call the Midwife". I haven't seen it mentioned here before but wanted share. I've become enamored by the show. You can catch up with the series on Netflix.

I'm having surgery soon and was planning to watch Kind Hearted Woman while recuperating. After reading the comments here, I think I'll pass. Something a little more uplifting sounds better for surgery recovery!

By the way, I bought a cookbook recently for the first time in years. DH loves to cook and used to be a photographer. I bought him Pioneer Woman's latest for the recipes and the photography. He really likes it!

Michelle, may your surgery be successful, and
your recuperation time be speedy.

Ok, off topic, but I just have to bring it up. Did anyone see the Duggars last night? I actually really like the Duggars, but last night's show got on my nerves. Anna and Josh invited the family over for dinner and a surprise. Either those Duggars are dumber than a doornail or were completely fake for this episode. Of course the surprise was (no spoiler alert necessary) "we are expecting!" The food was crap. A bunch of frozen processed junk. And very expensive for 25 people I might add.
* * * *

I haven't watched the Duggars show in quite awhile, primarily because I decided I wouldn't watch any more reality shows that feature minor children. Second, I got tired of their sanctimonious comments, and uncomfortable with the way their grown children never do anything with their lives besides take care of the younger children.

However, when I was watching, I was so surprised at how little they seem to know about simple nutrition. I would have thought that a family that stays at home all the time, and has a large piece of property, would have a wonderful garden that would provide them with seasonal produce all year long. I would have thought they might buy from local farmers during peak seasons and can/jar their own applesauce, preserves, and so forth. I would have expected to see them have a few chickens to provide fresh eggs for the family. These are all things that we did as children growing up in a family of 10. We had chickens, raised a pig, had a garden, etc. We shopped at the day old bakery and froze many loaves of bread for future use. During fair season, we participated in 4-H and my parents would buy a portion of a side of beef to last us throughout much of the year. All ways to economize, stretch that budget, and yet eat healthy home grown products.

Even though they homeschool, I know there is plenty of on-line access to cooking tips for healthy, inexpensive recipes. One of my favorite shows is Mad Hungry. One recent show was how to make supper from "nothing in the house." She made macaroni and cheese with the left over cheese in her fridge, a package of macaroni, a bechamel sauce (equal parts flour and butter, then add heated milk), topped with some bread crumbs. It looked absolutely delicious, and she served it with a side of steamed broccoli. Simple, inexpensive, fresh and healthy. Plus, it would feed a lot of people!

So yeah, mark me down as one of the people who can't understand why the Duggars cannot figure out how to cook healthier on a budget.

My mother LOVES that show, lol. Did you know they actually cast the babies before they're even born? After about a week they lose the "newborn look", so they have to film them a couple of days after they're born.

As for all this Bullyville stuff...SMH. This is going to backfire on her, and BIG time. The owner of the site is an adult? Seriously? I would have pegged him for a teenager based on his language. No wonder he and Kate get along so famously. I guess water finds its own level.

Who pays the lawyers in a class action suit? The answer is the winning complaintants. The lawyers don't charge anything if you lose but rake in a good 1/3 of what you win. At least that's the way it has worked in the past. They won't take a case they think is shaky enough to not hold up in the system. They don't want to waste the time when there will be no income from it.

I have a very, very dear friend who has just been asked if she would like to become part of a class action suit. I can't name the ones being sued, but if these complaintants win, there will be a huge payoff. And the lawyers will smile brighter than the sun with their 1/3.

2cents, why is Kate hiding behind Bullyville's skirts? She had the resources to hire an attorney and go after those she felt have defamed or threatened her years ago. I don't get this alliance except for mutual publicity.

Well, you learn something new every day. Thanks, Admin. A defendant class action is possible, but rare. Here's an article, if you're interested. I don't think the Bullyville situation fits the requirements, and would be massively expensive. My bet is that it is an idle threat and will never happen.

It is not yet clear if Kate will be a plaintiff in the announced lawsuit, though an insider tells us McGibney does indeed have legal standing to bring this type of action without her, as some in the anti-Kate consortium have threatened his life, with one even accusing him of hiring someone to kill her.

@Kateplusmy8 FYI: I am in favor of any legal actions to stop all forms of bullying--including death threats and stalking--and if it that requires a court room setting involving a class action law suit, I support it. As always, I will do whatever it takes to keep my family safe.

Susie Cincinnati said... 184

From my understanding of class actions, it's usually a large group of people against a big business or corporation. Generally there's only one defendant and if the judge rules in favor of the plaintiffs, the corporation pays out to the plaintiffs. Who pays if there is a multitude of defendants, which would be the haters? Who pays the attorney? Is it coming out of Bullyville's pocket if he's the one who files suit? How do you prove damages? A sheeple says, "I'm joining the lawsuit. Somebody called me an airhead."

This "I'm filing suit, police are coming, it's in the hands of the authorities," etc. etc., has been flying back and forth for years, by BOTH sides.

This is enough to give anyone a migraine.

Has Bullyville even asked Kate if she's willing to be part of this? She's really gotten herself into a pickle this time, and all for what,,,because she refused to take down her Twitter or go private.

Improbable Dreams said... 185

Susie Cincinnati ~ Apparently they DID ask Kate if she supported it, or if they didn't, she gave it a thumbs-up anyway.

Sorry for posting as anonymous above. I hit send too soon, but here's what Kate said about that "lawsuit" possibility on Twitter:

Also, if you are going to threaten to do something, just do it alraedy, don't threaten. Bullyville is saying that the woman who made the video has five hours left to apologize or information will be released. This sounds like a terrible parent threatening a child by counting to 3 but instead of following thru, they go to 4 etc. One, two, three, three and a half . . . #expectus LOL

-------------------------

So all class actions are done on a contingency basis, much like personal injury lawsuits?

What about damages, though...if there is one plaintiff representing a group, and there are multiple defendants, how is it decided who gets what? Certainly the case isn't heard on an individual basis, and not every plaintiff would have the same claim of damages.

Darrin breaks up with her, calls her a whore and a slut on Facebook, and then she goes back to him?? Pathetic. He is a loser who doesn't want her to better herself and has a jealous personality. I think Robin needs massive amount of help. Therapy maybe, or something.

Shelby you asked if she was on meds, she said she is but doesn't say what. However I think her personality is very soft spoken and slow to react anyway.

Where did the kids go when she was on her psyche hold?? Not their dad in prison. CPS didn't intervene then? Geez that's when they're most likely to intervene.

I have a pretty good feeling that any "sheeple" that joins in with this action (it if does indeed happen) would do so on their own behalf.

I read Ziggy's statement that she wrote last night as to why she is joining. It has nothing to do with Kate. Many of you here have no idea what has been written about Ziggy and her children.

Ziggy will be doing this for herself. I imagine most others will also.

Admin you say you have a message for Kate's fans and it's sincere then you start it out by calling us sheeple. We aren't sheeple. Could you try just a little respect?

I say people who have tired all other avenues such as ignoring, blogger reports, police reports, etc then yes sue. A group lawsuit might cost less.
______________________

Hi My2cents. I'm glad you felt you could post here. I will not answer for Admin, but I will give you my thoughts on this subject.

I prefer to call the people who follow Kate Gosselin her "fans." However, those fans who worship Kate beyond reason and who believe she can do no wrong truly deserve the label "sheeple." It is not a term that applies solely to certain Kate fans; it applies to anyone who shows blind devotion to any celebrity or person of interest.

Kate's sheeple blindly follow her wherever she may roam (figuratively speaking). I think this type of fan does so for any number of reasons, including: they are very young and don't know any better; they have been "wronged" by a man; they are very much like her, so her nastiness, disrespect and lying are non-issues; they view their children as possessions; they are enamored of any celebrity presence.

The sheeple group of fans simply refuses to acknowledge or accept that Kate has behaved in an abusive, cruel, disrespectful, hateful, selfish, ungrateful, deceitful manner, despite massive amounts of video proof.

I believe her fans who have behaved just as badly as some of her "haters" deserve to be called "sheeple." Somehow, however, the hypocrisy of her words and actions, and theirs, is completely lost on them.

One of Kate's biggest problems, aside from the fact that she is a sick individual, is that she equates criticism with "hate." So she goes into attack mode if she is called out on any of her bad behavior. Kate has done far more than her fair share of bullying - in life and on Twitter. Some of her Twitter followers have said some vile things about others and have even wished bodily harm on Jon. She has never once asked people to please not do that, so she has no credibility when she decries bullying.

You said that people should sue after trying avenues such as ignoring, police reports, etc.
Kate has clearly not tried ignoring this lunacy because she is still on Twitter. If she had really wanted to, she could have fixed this whole situation very quickly by getting herself off Twitter. She could then spend all that extra time tending to the needs of her children.

But she will never do that because Twitter is how she gets her fame fix.

Kate, if you are receiving death threats and are being stalked, contact your local police - not an internet blogger. My guess is that the first thing the police will tell you is to GET OFF TWITTER!!!!

With Kate's penchant for suing, wouldn't you think that she would have done this a long time ago? She didn't sue Robert (yet), but she would have bullyville represent her in a class action against the haters where she would have difficult time proving damages? That makes no sense. Why didn't she go after all of the people who commented on CC and try to prove that negative publicity and public reaction to her blogging may have caused her to be fired by CC?

I can't imagine that anyone, after this, would want to be associated with her in any way, including publishers, blogs, networks, and the like. What doesn't she understand about this -- that this would do her much more harm publicity-wise? Is it really worth it for a few dollars she might make from a lawsuit?
