Attorney and computer fraud expert Shawn Tuma's fantastic Federal Rules of Court 12(b)(6) Motion to Dismiss can be read in full here (if the link doesn't work trying reading the mirror on our site). Tuma rips Kate's initial complaint to bits, explaining why the lawsuit fails on multiple grounds, including statute of limitations, and accusations the lawsuit is a fishing expedition and doesn't come anywhere close to meeting all the elements of the various causes of action alleged.
"The timeline of the case is straightforward. In 2009, Plaintiff was aware of allegations that “Jon Gosselin 'hacked' into her e-mails, phone, and online accounts,” she was profoundly disturbed by them, and she was “carefully considering all of her legal options regarding this matter, and she [would] pursue them if and when the time is right."5 Now, roughly four years later, Plaintiff has apparently determined that the time is right. Indeed, the Complaint was filed one month prior to the release of her new cookbook. However, all of Plaintiff’s claims, except for the Identity Theft claim, are governed by a statute of limitations of two years or less and are time-barred. These seven claims should be dismissed with prejudice."

I'm sure the toll will be high - but this has been going on since nearly Day 1 for the sextuplets. They were part of a reality tv show since they were babies. That alone will take a toll. Then their parents were constantly fighting, and loved family members and friends would disappear from their lives because Kate would banish them. Their parents fought constantly.
Then the ugly divorce. Not to mention Kate's temper, unrealistic expectations and lack of any material instincts. Dragged hither and yon by their mother. Probably constantly being told their father is worthless. Having to constantly appease their mother and walk on eggshells. Frequent "spankings" with various implements.
This lawsuit is only one in a long string of craziness that has following these children for most of their lives, and most of it instigated by Mommy Dearest. Jon has no other option but to respond.
I, too, love LHOP. :) The episode where Mrs. Garvey and Mary's baby died in the fire broke my heart. On a trip to CA, we detoured to Simi Valley to see where it was filmed...yes, I ran down the hill. :)

"On June 22, 2009, Kate filed for divorce. After Kate filed for divorce, Jonathan moved out of the family home and into an apartment above the garage of the family home (the “Apartment”); Jonathan left the Dell Computer in the family home for continued use by his children. Jonathan was still permitted access to the family home during this time. On or about April 2010, Jonathan observed the hard drive of the Dell Computer was failing so he performed a backup of it and stored the data on DVD disks."
He made two backup dvds, one for himself and one for his former wife.
It doesn't say whether or not he told her he had made one for her, but she wouldn't have heard anything he said anyway. She wanted him out. Maybe he didn't and just left it on the desk, but not his fault if she threw it out.

Kate had better not be tampering with Jon's witnesses. They should be in the Witness Protection Program.
The terms "disc" and "drive" are semi-interchangeable. A "drive" contains discs, which act as the media on which the data is recorded. A "disc" can be either a hard drive (older term) or removable media like cds and dvds. Backups are usually made to removable media.
Techies use the both terms.

I also remember Kate having a laptop on a road trip for the show, maybe on the Disney trip or the first beach trip when they were looking at property along the way. Maybe the laptop was "hers" and the desk top was "his" even though they shared? That's how it is at my house, at least. We have a few devices to share, but the desktop is in the man cave and the laptop sits at my chair in the living room. Our music and picture/video files are stored on hubby's desktop because it can hold more data.
ExNurse (198) I may be mistaken, but Jon was still allowed "on property" after the divorce, and may have spent some of his custodial time with the kids at the house, even after finding another place. So if the Dell in question was left with the kids, for example, Jon may still have had access. Also, considering the age of the computer and his expertise, Kate may actually have wanted him to keep it running for the kids' use and specifically granted him access to the computer. According to him, she would have known he already had the backup discs, so there would be no harm in him getting on, unless she was using it herself for banking or emails. I doubt that though, because as Remona mentioned, Kate had her laptop.
Jon's version is just so plausible, and is how I would handle a marital computer if I were divorcing. Nothing he said makes me scratch my head wondering why he did something in a weird or convoluted way. This was his computer as much, perhaps even more than, Kate's. Her allegation of hacking is stupid to my way of thinking. I would not think my husband was hacking my computer or stealing my identity if he logged into his own computer. Even if he used my passwords to see a bank account or check on emails- he knows my passwords because he is my husband and I am not hiding anything from him. Also, step number one if I were divorcing would be to change all my log-in information so he couldn't nose around my information, no matter what computer he was using. That's one thing with the hacking into her accounts part that doesn't make sense to me; Jon would not have to use Kate's computer to access any online account. That could be done from anywhere and he probably knew her passwords (if she hadn't bothered to change them).

For a while there, they traded off weeks in the house. It was the "kids' house". So when TFW was there, she had the master bedroom and the house. When Jon was there, he had the garage apartment and the house because he watched the kids the alternative weeks he was there.
I don't doubt that TFW also left a list of stuff he was supposed to do (or not do) while there, including fixing the broken computer.

TFW really needs some careful coaching before her upcoming media interviews. Her crapbook is way less interesting than her ex's recently filed suit for dismissal of her ridiculous lawsuit. Under oath is a catchy phrase.

Agree. Anything but courteous, and I really doubt that she was trying to cooperate, especially if it's true that she made a call to the police. That's hardly cooperating with your soon-to-be ex-spouse.

Excellent point. When Jon was accused of "stealing" money, this is how I think he did it. He transferred funds over to another account all the while KNOWING the passwords etc. Frankly he was in the right. A friend of mine was blindsided by her husband when he told her he wanted a divorce and that he was in love with someone else. She IMMEDIATELY took HALF of the liquid assets out of their JOINT accounts and opened up another personal account. Smartest thing she could have ever done . I would love to know how/why Jon had to "repay" what was rightfully his?

Maybe none. Wasn't he accused of stealing the hard drive? We now know that it was inside a desktop computer, not a portable hard drive. If he took the computer, with TFW's knowledge into the apartment, why would she say it was stolen at all? Nowhere does it say that the whole computer was taken. I find that odd, that's all.
And I didn't say her call was courteous. I said that she gave a courtesy call before getting rid of the stuff. That surprised me.The motion said that a short time later, after April 10th, the drive failed, and that Jon then destroyed it. The fact that he was allowed into the house after he vacated the apartment surprised me, too. Certainly discredits RH's description of that dark and stormy night. Sure didn't seem like Jon would be in the house for any reason, let alone dealing with a failing computer. If Jon had had possession of that computer for personal use, I think that would have been made clear because how could he be accused of stealing it? I'm quite sure that Jon, circa 2009, had a laptop, and, probably a damn good one. Sorry, this part just doesn't compute. He was buying cars, living in NYC and jet-setting. But, he has to use a castoff desktop? That is why I asked that question.
Not so long ago, people were insisting that Jon had absolutely nothing to do with the disks. Now we know that he did. And, still, people pounce on someone's complete speculation that he must have had it in the garage with him, assert it as fact, and then become annoyed when another possibility exists. It just isn't logical. I can understand that people don't care, or feel like anything he may have done is justified. I just don't understand attacking me or anyone because they feel that it doesn't quite add up. If you don't agree with the logic, then refute it.
For the kids' sakes, I hope this motion will put an end to it, once and for all. Obviously, RH is not going to rethink putting out the book, so, it still won't be over for them. Hopefully, he will have cleaned it up and taken his personal snark out. If any good will come of it, it has to be well-written, with commentary limited to providing some context. His taunting behavior is childish and immature. I sincerely doubt that his latest video is part of some scathingly brilliant plan.
Re ROL: Of course they have, saying Jon is playing "dirty" by bringing the kids into this. He just said that the kids told him that Kate threw the trash out. But now, he's the bad guy?
Since when is answering a lawsuit with the truth considered playing dirty? Plus, they couldn't have told Jon anything if there was nothing to tell. Imagine how traumatizing it must have been for them to hear her tell of, or witness her actually throwing Jon's things out in the trash.

I think it depends on the kid. Of the Gosselin children, it's Colin that I feel most sad for. He tried so hard when he was a little boy to please his mother, and all he got in return was misery. Whenever I see a picture of him, he seems detached.
However, the saving grace is they do have their father, and when they are with him, access to other loving family members. So I think that's what will provide them with some form of antidote to their toxic mother.
Children don't need perfect parents. But they do need to feel loved and accepted and cared for. I think Jon provides that to the best of his extent.

Woe is me, summer's over.Happens every year. Kate's bog is way over the top. So Jon and Robert's accounts don't quite jibe. I think this points to a total lack of collusion on their part. Robert told what he knew of what he heard and saw on the night he helped Jon move. Kate said she would throw out everything that was left. The next day there was a big pile of stuff on the side of the road. Robert would not know if all the the material on the roadside came from the garage or not. TFW and friend might well have done a sweep of the mansion and discarded anything that they considered Jon's. Does it really matter what came from where? How would Robert know of Jon having a private conversation with TFW about the disposal of his belongings? I'm just not seeing this as a headbanger set of discrepancies.
It's a bit counterintuitive, but slight variations in stories can be a good thing. It shows you didn't sit down together and say ok so what's our story gonna be?

ITA, Admin. Their stories are slightly different. That's normal. And we have all experienced a dying hard drive. You make back up copies. I wish Jon would refrain from these types of interviews. I know he means well but he really tends to overshare and he never acquits himself very well. The gossip sites then piece and parse his words in ways that really discredit him. He should know this by now.

What would it take to get psychological exams for each of the kids? I wonder because I think some judge has to mandate that Jon and Kate get a mediator and undergo counseling so that they can finally co parent together.
I can't imagine the anxiety the children must feel, knowing that their parents loathe on another. That they love the parent that the other parent hates. That's got to take a mental toll.

I love that he outs her as having a nanny. So much for poor single mom with eight kids. I saw Jon's interview on ET. The lawsuit was mentioned in a voiceover, and when asked directly "Did you hack Kate's computer", he said that he couldn't legally talk about it. I'm glad that he didn't talk about the case. Good for him.
Also, at the end they did mention that he filed a Motion to Dismiss.

Jon's Motion to dismiss explains about the DVD back ups...
"Once the divorce was final, Jonathan was required to move from the Apartment; Kate
continued living in the family home.
When Jonathan moved from the Apartment, he left Kate’s copy of the backup DVDs in the Apartment in a box along with other items he believed Kate
would want. He informed Kate that the DVDs were in the box.
The following day Kate called Jonathan and asked if he would be returning for any other items left in the Apartment and he responded that he was not and she could discard the items as she saw fit.
The children told Jonathan that Kate (and a friend of hers) threw away in the trash everything left behind in the Apartment.
Jonathan has not wrongfully access any computer, online accounts, or telephone
belonging to Kate—it is far more plausible that Kate herself threw out the DVDs in the trash.
Shortly thereafter, the hard drive of the Dell Computer failed. Jonathan destroyed that
hard drive in a manner consistent with his training by taking it apart, removing the physical disk...."
So, everyone... I see no discrepancy between Jon's story or Robert's. The MTD doesnt fill in every detail and that is okay. When Jon moved out of the apartment, it could have been a dark and stormy night. The police could have been called.
I seem to recall that Robert said he went back to the residence at a later time and picked up the bags of trash from beside the road. Later could mean , that night, the next day , a week a month...but likely befor ethe next trash pick up day) I got the sense that he might have been picking up their trash for a while.
The first few paragrapsh give Jon's timeline. It's Jons MTD, not Roberts. Why would JOn need to mention about Robert getting the DVD's?
Anyways, people were speculating on when where who, etc. To me the only thing not clear, is where the computer was after Jon moved out of the apartment. I am going to think that because it isnt mentioned, it remained in the family home for the kids to use.
Also, as for TFW blog about fish....
Most people let ALL their kids pick a name for the fish. Why did Kate get to pick the name for one fish, and Mady the name for the other?
I know kate would say t would just be CHAOS trying to all pick one name, but hey classroom full of 30 kids do this all of the time.

I agree that Jon's appearances are done with the approval of his attorney. Jon has been very very quiet for a long time, and I feel sure that if his attorney had told him to be silent, he has shown that he is able to keep his mouth shut.

Does anyone remember if their very first beta fish was Mady's also? I seem to remember something like that. So if it is true is it favoritism towards Mady or do not a single one of the other 7 kids want a fish of their own? With that many kids I would invest in a nice 20 gallon tank and get several fish so they each got one as their own.

Just checking in, but I am so glad that Jon finally has a decent attorney. I read the 26 pages, a lot of the argument seems to be common sense. Totally believe as the lawyer mentioned, this case was submitted one month before the release of her "cook book" all for publicity to keep her name out there. Has she reached 600 hundred in sales yet? Don't think so. Maybe 6 -10 a day, all at the expense of her childrens' father. Karma is going to bite her in the butt big time.

I think the timing of this is hilarious. Can you imagine getting ready for a book tour, tweeting excitement at meeting fans, riding the celebrity train once again, only to have it in the back of your mind the whole time that your foes have just hired two fantastic attorneys, one of whom is a legend? Kind of puts the damper on your festivities, wouldn't you say?
I wondered how they were managing to pay for these well powered lawyers too, but perhaps they only take on cases they know they will win and part of their argument is that TFW will have to pay their fees and any other damages/expenses.
I don't have any problem with Jon doing interviews. Lately he has avoided talking about his children except in a generic ways or about his own private life - like where he's working.

Improbable dreams - I don't know the answer to your question (about why a high powered attorney like Tuma took Jon's case). I think that it is probably a combination of selfless and at least slightly self-promoting reasons. Selfless perhaps, if Tuma is doing this because the issue is something he finds interesting, and one he thinks needs some legal clarification. He may see this as a case in which some common misconceptions regarding these issues can be better defined.
If he prevails on Jon's behalf, he will be able to add this to his "resume" and include it in any further articles he publishes or talks or courses he teaches. It might gain him some further notice in the legal field.
I can't say for sure what his reasons might be. But I am impressed with the attention to detail, and the legal knowledge he displayed in his motion. I would say he is a force to be reckoned with.

Yes, including my parents. And they never made a big deal about having 8 kids and I know they would have liked to have more but felt they were past their prime. So 8 it was and while we were a busy household, my mom never once complained or acted exhausted. My mom was and is an amazing energetic woman who once said she never really liked children, except her own! LOL. And she lavished love and attention on us and always made us feel special.
I think that's why I have this interest in the Gosselin children, because I see that they never once got anything like maternal love from their mother. I feel for them and wish somehow that they find true unconditional love from their dad and other relatives in the family. I count my own blessings every day.
I *love* that gosselinbook's atty "aggressively represents" his clients.

You know, I wonder if Razzmatazz has created ill will in the legal field, and that's why two high powered attorneys are willing to take him on regarding this ridiculous lawsuit? Or perhaps its McGibney and Razzmatazz both? Something is up when Martin Garbus is willing to get involved. Fascinating! I can hardly wait to watch this all play out.

I believe you might be the only one with that feeling. I well remember a poster somewhere else years ago also quite sure that Jon & Kate were divorcing as a ratings booster and would reconcile for another ratings booster. That, clearly, was not the case.
Rest assured, Jon and Kate are not in cahoots on anything. But I did get a good chuckle from that earlier memory.

Hmmmm, well I feel that's not quite accurate. I agree that Jon is sometimes a doofus, even a big one. But his heart appears to be in the right place.
Where I usually have to add my 2 cents in Jon's defense is to any post that compares Jon and Kate and finds them equally bad. Or to any post that still finds fault for Jon's actions of years ago, as if it were yesterday.
As to his recent behavior - I can't say much about it because I don't know much about it. He's gone private. He is working as a waiter, has his kids about 50% of the time, is doing what he can to make ends meet, and seems to be a genuine loving father. If in addition, he's slightly goofy, oh well. At least he doesn't hit his kids with a spoon or a heavy cardboard roll.

Everything happens when I am gone! So much reading to get caught up on, but am so happy that both Jon and Robert have excellent Lawyers. I did catch ET today, and really, really loved that they showed the clip of TFW screaming at Jon in the store, sure makes her look like an idiot. I wonder how she felt seeing it! It has been so long since we have had any strong hope about her getting what she deserves, it almost feels like Christmas is coming early!

When he said we might make a little new law in the process, that's something an attorney would say when the subject they are working on is missing some case law and they hope to help make some. The statutes lay out the law but the case laws interpret and clarify what the statutes mean and how to apply them to various situations. When a law is new there won't be a lot of cases on it and so no one is quite sure yet how to work the statutes.
He might take this pro bono for that reason. I can definitely see a case with facts like this in a law school textbook. A fair amount of celebrity cases make the textbooks if they demonstrate the issue well enough. I think they do it so you'll remember them and also because a lot of these cases just tend to be good cases to know and understand in order to understand the law. We read cases involving Barry Bonds, Carol Burnett, and Larry Flynt, off the top of my head.
I imagine this new area of law really doesn't have a large collection of case law yet. Attorneys get nerdy excited to be part of shaping case law on subjects they are passionate about. This is an area he has established himself as a leading expert on. Feather in his cap to pick up this case, a resume booster. Most laws have one or two seminal cases. To be able to say that was your case is a badge of honor.

I can see a seasoned attorney who cares about the First Amendment and civil rights getting involved in this case. Bullyville's vigilante justice may just have crossed the line. I would personally love to see a countersuit against Bullyville for their involvement in intimidation and cyberstalking. This is going to be fun--and educational! Didn't Kate say that she is all about education? Then, she is going to love what is next for her, because I think she will be getting seriously educated, and, hopefully, a huge smackdown with some punitive damages. If these big guns are involved, it is because they will go big with this.
And when the kids are 18, TFW may be facing 8 little lawsuits against her.

Poor Kate. It's just not turning out to be her day. A widely panned blog piece, 2 top of the heap lawyers aiming their guns at her lawsuit, and that pesky woman from the ranch in the middle of nowhere has sold nearly twice as many cookbooks in the 19 days of September as Kate has sold since March 29. I don't think there's any way in the world Jon or Robert could afford to pay either one of the attorneys, let alone both (Robert said he had no money and I think we can assume Jon has none, too).
With the new info about Martin Garbus representing Robert, I'm wondering if he was hired first and then in turn put Jon in touch with Shawn Tuma. The attorneys specialize in different parts of the law and it makes sense to have the appropriate experts to best defend the various important points of the suit.
I think this suit is much bigger than just TFW vs Jon and the attorneys have taken the cases because of the larger implications, ie: constitutional rights, free speech, internet law, etc. I don't think either one expects to make any money on this. Maybe Jon and Robert will pay filing fees and court costs, but I'll bet the attorneys are either pro-bono or they're being funded by something similar to a non-profit constitutional rights group.
I'm so pleased and relieved that the attorneys believe in Jon and Robert's cases and feel that the laws that apply are important enough to warrant their high powered participation. If this ends up being about issues like BV threatened, these attorneys may actually end up defending *our* rights to blog, express opinions, and better define internet free speech.
This is going to be very interesting. Pass the popcorn, please.

Then dumb ol' Kate issued orders to her "friend" to dispose of all of Jon's property and the backup CD meant for Kate got thrown in the trash. Ahhhh. Poetic justice at last. Now it all makes sense. Jon didn't steal squat.
I cannot imagine Jon was aware Robert would go through that trash, but Robert worked for a tabloid and was looking for a big score, and boy did he get it. When I think about Kate's convoluted thinking about a Jon and Robert conspiracy, I just have to believe the woman is driven by hatred and spite towards Jon that is consuming her.
Nearly every source printing items about Jon's ET interview also include a snippet about Robert Hoffman and his book's title. Some even include short sentences about Kate's alleged abuse.
Kate thought yanking this book from Amazon so quickly and suing to prevent its release would eliminate the chances of people ever seeing or talking about it again. Au contraire.

I am late responding to this because I actually "Gasp" work 12 hours as a nurse but the episode you are referring to is when they went to Disney. They were packing the van and Jon clearly tells Kate the laptop goes up front and when she ask why he says so you can journal or whatever.

She's still tweeting, just not on Kate's timeline. Most of her tweets are retweets of conservative news articles, platitudes, that kind of thing with an occasional RT of BV or mention of Jon. She has to be concerned - didn't RH include her tweets in his book? And since then, there's much more for him to work with. She may have deleted tweets about Jon's body parts, as well as many coarse and vulgar tweets that may be libelous, but there are lots of screenshots out there.
The above holds true with CJ, also. After she removed the outings and much more from her blog, she's rarely been seen on Kate's timeline, and she had been there 24/7.
Quite a few other previously vocal fans have gone silent. I don't think they've lost interest. I do think some of the smarter ones now realize that they can be involved in legal actions, too.

Your opinions (and quoted material helps confirm my belief that Jon & Robert's attorneys may be doing this for altruistic reasons, but that they are also responding to what they see as broader issues, with wide-reaching implications. I can easily see the appeal at all ends of that spectrum.
